I was told I had 18 months to put in an objection to my Great Uncles Will if I wasn't happy with the outcome of any decisions that had been made. I hope that makes sense ?:|

It should really be done before probate is granted and the will has been distributed. Do you really think someone will give back something they have inherited just because you do not like it?

Hi and sorry to hear that you may have to try and dispute a will.....that cant be easy. There are free womans legal nights in many cities........perhaps if you contacted a womans community group they maybe able to help you .........Good luck:)

Lyndal, perhaps it's not the OP who doesn't like it, perhaps it's someone else who doesn't like what the OP has received and wants a share of their inheritance.

If I remember rightly, once it has passed probate that is the end of the matter, so if you want to dispute it, then it is best to do it quickly.

Suggest you seek legal advice tho as every situation can be different.

Ive not had a lot to do with wills but isnt that why the put those notices in the Newspaper

...anyone with a claim on the estate of the late Gladys May of 123 smith street........ must contact this office within 30days....blah blah.... etc.etc...


??

Best thing to do is get some legal advice quickly. That way the person would know if they had a case or the time has expired where they can challenge the will.

Think very carefully about it, in my limited experience it really causes a lot of heartache on both sides.

Ive been cut out of my dads will and fully intend to contest it when he goes, he has left i think his house to my daughter but not till she is 50 or something, she is 21 now and he is in his early 80's i think, if he pops off in the next 5 years its rediculous that she has to wait 25 - 30 years to get anything.

I guess the best time to contest it is at the reading of the will???

Its odd as there was NEVER a reading of my mums will, im sure she had one, but i knew nothing about it.

No they only concentrate on the beneficiaries in that will.

If the person dies without a will it will go through the Public Trusties and they will endeavour to contact all surviving relatives.

This may take years and after fees there is often little left to be disbursed.

To suggest any will is debatable is unfair, wrong and against the wishes of the deceased. Assuming ...

That the deceased was of sound mind, with no coercion, and the will was appropriately witnessed and verified. Then ...

Perhaps the honourable thing to do is to take it on the chin. There was a reason why you were excluded, accept it and move on.
